Proposed Legal Changes for Young Victims

Under current New York law, the statute of limitations for reporting childhood sexual abuse is five years. It begins running when the victim either turns 18 or reports the abuse to the authorities. However, proposed changes to our state’s laws could help sexual assault victims who have missed this deadline.

If these changes are passed, the statute of limitations will remain the same, but will not go into effect until the victim turns 23. In other words, victims of child sexual assault with have until the age of 28 to report the crime to police. After criminal charges are filed, victims have one year to file a civil suit against their attackers if they choose to do so.
